Unless you've been living under a rock, or perhaps a large Android phone, chances are you know that both Samsung and Apple have been at loggerheads for some time, both claim and counter-claim all kind of weird and wonderful things.

The last battle in the war-arc between the two giants is all about the iPhone 4S, with Samsung trying to stop Apple from being able to sell its latest smart phone in Italy, of all places.

As expected, Apple does not like the idea so much, and as such, the couple has been slogging through the courts.

It seems that Apple has drawn blood for the first time in this particular battle, after a judge ruled that an Italian court could actually sell Apple iPhone 4S eager buyers in the country, although Samsung claims that the device violates intellectual property rights.

Apple has continued to flagrantly violate our intellectual property rights and free ride on our technology. We believe it is now necessary to take legal action to protect our innovation.

Samsung is particularly upset about Apple's use of wireless communication technology, the Android and Windows Phone 7 partner claims infringes on two of its patents.

Infringed technology is essential for reliable operation of telecommunication networks and devices and Samsung believes that the violation of Apple for being too serious and that the iPhone 4S should be excluded from sales.

The case is not over yet, though. The Italian judge has accepted the request of Apple and Samsung to be allowed to submit more evidence. That the new evidence will be reviewed at a hearing on December 16.

Apple had been established to bring the iPhone to Italy on Friday, 4S, which can now go ahead as planned, pre-orders have started last week. Someone at Apple was clearly confident that they would not be forced to postpone the launch of a value of millions of dollars.

Samsung will now continue its efforts for the iPhone 4S banned in other countries, including Japan and Australia, after Apple has succeeded in getting the Galaxy Tab 10.1 barred from being made available to customers in Australia already.

Why can not we all just get along?
